Cross Examination Of Brian

0800hrs the bringing Brian into the holding cells,where i’m waiting to go over the possible ways the Crown could attack his testimony. I was well aware of his past encounters in Mexico and that was one of the various reasons I hesitated to put him on the stad to begin with. Not that i could have foresaw just how badly Brin was going to destroy my carefully constructed case of doubt.

0900 hrs the bailiff calls us to rise as Judge Dillion comes in,banging his gavel we’re allowed to sit. Brian is already on the witness stand,sitting comfortably. “So Mr Dewer is the defense ready to call its next witness?”

“The defense rests its case your honor!”

“Well, then is the crown ready to cross examine the witness?

“We are your honor!” Standing Mr. Hewitt begins. “So Mr. Dermott,you claim,everything was consensual correct?

“Yes!”

“And is all your sexual encounters consensual?”

“Again “Yes!”

“Including one with Miss Conchita Rodriguez of Chichen Itza,Mexico, last year?”

“Don’t know who you’re talking about?”

“Well let me refresh your memory!”

“Objection Your honor,what allegedly occurred in a foreign nation has no bearings in this trial. If the crown want to enter this as testimony then defense demands the right to cross examine said witness on the stand!”

“Your honor crown will established that the defendant has committed said offense in the past?”

“Then as i stated defense demands to have the crown’s witness on the stand in this court immediately when crown rests!”

“Counsel approach!” Leaning down to us “Mr. Hewitt, Mr. Dewer is correct in demanding a chance to cross examine any evidence that you present in cross examination, so unless you plan to reopen the crown’s case then his motion is sustained! Do you plan to call said witness?”

“No your honor we don’t!’

“Then rethink your line of questioning!” Then to the court in general. “ Objection sustained,jury will disregards the prior question. Crown may continue!”

“Mr. Dermott can you explain why your father wrote a cheque to the Rodriguez family for 50 thousand American dollars?”

“Objection,calls for speculation on behalf of the witness!”

“Sustained!, the court warns the crown for the final time if you plan to present evidence during cross examination,said evidence must be physically here in the building before i’ll allow you to proceed!”

Mr. Hewitt sighs but continues “Mr Dermott! Can you tell the court why a twenty years old hangs out at a high school?

“I met Mary through a mutual friend and we dated on and off since then.”

“So you’ve been to her home before the alleged incident?”

“Many times both with her mom and sister home or alone.”

“And would you say you were welcomed?”

“I was never told to leave if that’s what you’re implying!”

“And did you ever tried to have sex with any of the Crompton women before that night?”

“May have, i can’t say i remember!”

“Ah can’t remember but you can remember the fantasy you told to the court! The one where they all wanted you?”

“It’s not fantasy it was what happened, you weren’t there!”

That’s when my case was torpedoed by the little shit with help from the crown
