The bailiffs wrestle Brian out of the witness stand and out of the court.The jury is escorted out to their chamber as the judge orders the court cleared and Hewitt and me to his chambers.

“Well i must say in all my fifteen years on the bench,i have never seen such an outburst as that. I take it the defense objects to Crown’s statement but and I quote “shut your fucking mouth” is not acceptable in my court.!” Shaking his head before continuing “Mr. Hewitt if that wasn’t badgering the witness then nothing is!”

“I don’t approve of how it was obtained but i can’t ignore what comes down to as an confession on the stand!” Turning to me “Mr. Dewer i suggest you go talk with your client and tell him the seriousness of what just occurred. Court is in recess for an hour.”

I Immediately go to the holding cells and find Brian. “Congratulations Brian! Without even being asked you killed defense and any hope of the jury finding you innocent!”

“Can you object to his questioning me?”

“Way too late for that now, you gave what amounts to a live confession on the stand! If I was you Ii go back in and change your plea and throw yourself on the mercy of the court!” Turning to leave before I reached in and strangle him.

And to his credit Brian did just that, while still on the stand he asks the judge if he could change his plea. The gallery oohhs and the judge call for order then to the crown “And does the Crown accept this new plea?” Mr. Hewitt looks to me than to Brian “We do your honor!”

To the jury “Well this changes everything ladies and gentlemen of the jury. The court appreciates your time and efforts and now discharges you from your duties.”

“The defendant will return to this court in six weeks time for sentencing!’ with that the court convened. Mr. Hewitt came over and shook my hand,which i accept out of respect not for a job well done.

Six weeks later we reconvene at 0900 with “Brian dressed in a three piece suit, sitting beside me at the defense position. For the most of the morning victim impact statements are read for the record before Judge Dillion gives his verdict. Having Brian stand the judge begins.

“Mr. Brian Dermott you have plead guilty to the charges of Sexual ****,****,Forcible Confinement and this court find your acts to be heinous and uncaring. Taking into account the evidence presented i find i can not in fairness to he lives you have ruined,not sentence you to 20 years in Millhaven Institution with parole eligibility not to occur before one third of the sentence has been served. The court has taken into account the time you spent in detention and has adjusted the length of the sentence in accordance the criminal Code of Canada.

“Looking straight to Brian, in my years on the bench i have rarely seen such callous actions that have great impact on lives as your has. It is my hope that during your time you will come to learn what consequences your actions have caused and come to show remorse for your action . Banging his gavel the trial of Brian Dermott comes to an official end.

Later at home in front of the TV. “And in his statement Judge Dillion called Dermott’s actions Heinous and uncaring! Reporting from the Brampton Courthouse,Andrea Classton CTV news!”
