TAKE IT DOWN Act Policy

CHYOA provides a process for individuals and their authorized representatives to request the removal of nonconsensual intimate visual depictions, including both authentic visual depictions and digital forgeries like manipulated or AI-generated depictions commonly referred to as "deepfakes". It is the policy of CHYOA to respond to takedown requests in compliance with the TAKE IT DOWN Act (Pub. L. No. 119-12).

If you believe that you are identifiable in any intimate visual depiction accessible on CHYOA that was published without your consent, you may submit a TAKE IT DOWN Act Notice to CHYOA's designated TAKE IT DOWN Act Agent with the necessary information as listed in the "TAKE IT DOWN Act Notice Requirements". You may also submit a TAKE IT DOWN Act Notice if you are authorized to act on behalf of an identifiable individual depicted in an intimate visual depiction published without their consent.

TAKE IT DOWN Act Notice Requirements:

• Identification of the intimate visual depiction of the identifiable individual and information reasonably sufficient for us to locate the visual depiction. (Please provide a description of the material and a specific URL link or links.)
• A brief statement that the identifiable individual has good faith belief that all intimate visual depictions included in the TAKE IT DOWN Act Notice were published without the individual's consent, including any relevant information for us to determine that the intimate visual depiction was published without the individual's consent.
• Contact information of the identifiable individual or a person authorized to act on behalf of the identifiable individual.
• A physical or electronic signature of the identifiable individual or a person authorized to act on behalf of the identifiable individual.

After receiving a complete and valid removal request, we will

• remove the intimate visual depiction of the identifiable individual, and
• make reasonable efforts to identify and remove any known identical copy of the intimate visual depiction of the identifiable individual.

These actions will be taken as soon as possible, but not later than 48 hours after the request.

Note: Some images accessible on CHYOA aren't hosted on CHYOA. If the takedown of such an image is requested, CHYOA can and will only remove the link, so the image won't be accessible on CHYOA anymore. To remove the image from the site it is hosted on, you might have to contact that site and request the removal there as well.
