Is this legal?

“By the way” Kurt says “You mentioned about it may be coming down to straight **** ride on Mandy. It’s a good point, is this all even strictly legal? My understanding was that anything done under the effects of a GAME will never be classed as a criminal act unless it affects someone who was not playing. But is this covered? My law modules are for the outside world, you’re the one who has covered this fucked up place.”

“Well”, you sigh “Being honest it is strictly a grey area. **** from cream pie is an OUTCOME of the GAME so not **** in any case. As for anything else the way it was explained to me was that cases in which a participant's actions are shall we say, adjacent to the intentions of the CONTEST or OUTCOME are pretty difficult to prosecute. Aiding and abetting just never reaches court. In other words, as a direct participant, I am basically covered for any normally criminal activity I commit against Mandy which is directly related to winning the GAME. Drugging, ****, **** etc.

“And me” says Kurt coolly.

“Well truth be told not many cases get to court at all. Although the GT gathers a lot of data, a lot of the data gathering itself involves magic which isn’t recognised as admissible in the outside world. But in any case, there’s a little-known legal doctrine that has been tested by case law once or twice in GAME cases. It’s called consequential provocation.”

“Which means?”

“Simply that actions that were provoked as a result of the GAME will be treated as a consequence of consenting to participate in the GAME. This supersedes any specific consent given”

Kurt isn’t stupid but you are not sure he has fully following the implications. You go on.

“Basically, if you get fucked, **** or whatever, by anyone, even non-participants, directly because you chose to participate in a GAME you can’t retrospectively withdraw your consent. It probably also covers getting **** and kidnapped as well in some circumstances but that’s more of a grey area and untested. For our purposes I think we’re good though”

Kurt grinned “So Mandy doesn’t have any legal protection”

You smile along with him “And we just need to make sure she is missing any other protection as well”
